Terms of service and use of the site

1. General provisions

1.1. Site and company. These terms and conditions govern the relationship between Thorsen Optics LLC (hereinafter referred to as the "Seller") and any person visiting or placing an order on the website www.thorsen.com.ua (hereinafter referred to as the "Site").

1.2. Acceptance of the terms and conditions. By using the Site, including placing an order, you agree to all the terms and conditions set forth herein. If you do not agree with them, please refrain from using the Site.

1.3. Changes in conditions. The Seller has the right to change these terms and conditions without notice. The new version comes into force from the moment of its publication on the Site.

2. Definition of terms

• Website- a web resource www.thorsen.com.uacontaining information about the products and terms of their purchase.
• The selleris Thorsen Optics LLC.
• Buyer/User- any legally capable person over 18 years of age who uses the Website and places an order on it.
• Goods- night vision devices and accessories available for sale on the Website.
• Order- a duly executed application of the Buyer for the purchase of the Goods.

3. Subject matter of the agreement and rights of the parties

3.1. The Seller undertakes to transfer the selected Goods to the Buyer's ownership, and the Buyer undertakes to accept and pay for them.

3.2. The seller may, at its sole discretion, change the assortment, description, price, and stop selling goods without prior notice.

3.3. The buyer has the right to:

• view information about products, prices, and conditions;
• place an order and receive information about its fulfillment;
• request warranty repair, replacement or return of the Goods in accordance with these terms.

3.4. The buyer undertakes:

• provide true information about yourself;
• pay for the Goods and delivery services;
• use the products in accordance with applicable laws and regulations.

4. Website use and copyright

4.1. The content of the Website (text, photos, videos, graphics, code) is subject to copyright. It is prohibited to copy, distribute or modify the materials without the written consent of the Seller.

4.2. You are allowed to view and download materials for your personal, non-commercial use.

4.3. Users are responsible for their comments and feedback; it is forbidden to publish illegal or offensive materials. The seller may delete such messages without explanation.

5. Ordering, registration and security

5.1. Without registration: you do not need to register on the Website to place an order. It is enough to provide the minimum personal data (name, phone number, e-mail address and delivery address) required to process the order.

5.2. With registration: the user can create an account for easy order tracking and saving data for future purchases. Registration is voluntary.

5.3. Responsibility: the registered user is responsible for the security of his login and password and all actions performed under his credentials. In case of loss of access or suspicion of unauthorized actions, the user must immediately notify the support service.

6. Prices and payment

6.1. Prices for the Goods are indicated in UAH and are subject to change. The current price is displayed at the time of ordering.

6.2. Payment is made in one of the available ways: non-cash payment by card, cash on delivery, or other methods available on the Site.

6.3. The order is considered accepted after confirmation of its payment (in case of prepayment) or after clicking the "Checkout" button (in case of payment upon receipt).

7. Delivery of goods

7.1. Delivery is carried out within Ukraine (except for the temporarily occupied territories), as well as outside Ukraine by agreement and in accordance with export control legislation.

7.2. The Buyer chooses one of the delivery methods available on the Site: pickup, courier delivery, delivery by postal services, etc.

7.3. The cost of delivery is paid separately and is determined by the carrier's tariffs.

7.4. Title and risk of accidental loss or damage shall pass to the Buyer upon actual delivery of the Goods.

7.5. In case of refusal to receive or inability to deliver the order due to the Buyer's fault, the Seller may cancel the order. The Buyer shall reimburse the delivery costs, and the funds for the goods themselves shall be refunded in accordance with the terms of return.

8. Warranty and returns

8.1. The product is accompanied by a warranty, the term and conditions of which are specified in the documentation.

8.2. The buyer can return the goods of good quality within 14 calendar days, provided that the presentation, packaging and complete set are preserved.

8.3. In case of defects during the warranty period, the buyer is entitled to repair, replacement or refund.

8.4. Refunds are made to the Buyer's bank account within 7 business days after receipt and inspection of the goods.

9. Limitations and liability

9.1. The seller is not liable for damage caused by improper installation, use or storage of the product.

9.2. The Seller shall not be liable for delays or inability to fulfill obligations due to false or incomplete data provided by the Buyer.

9.3. The purchased devices are intended for lawful use. The buyer undertakes not to use the equipment for illegal activities.

9.4. The seller reserves the right to refuse service in case of violation of the terms of this agreement.

10. Privacy and data protection

10.1. The Seller processes personal data in accordance with the Law of Ukraine "On Personal Data Protection", using it to fulfill orders and communicate with the Buyer.

10.2. Information about the Buyer shall not be disclosed to third parties without his/her consent, except as provided by law.

10.3. Details on the collection, storage, and processing of personal data are specified in the Seller's Privacy Policy (available on the Website).

11. Age and legal restrictions

11.1. Only persons over the age of 18 may purchase goods.

11.2. The Buyer undertakes to comply with the export control rules and not to export the goods outside Ukraine without the appropriate permits.

12. Force majeure

12.1. The Parties shall be released from liability for failure to fulfill their obligations in the event of force majeure (war, natural disasters, man-made disasters, etc.).

12.2. The party that cannot fulfill its obligations due to force majeure shall notify the other party immediately after the occurrence of such circumstances.

13. Final provisions

13.1. These terms and conditions are a public contract. All legal relations between the Parties shall be governed by the current legislation of Ukraine.

13.2. Disputes shall be resolved through negotiations, and in case of failure to reach an agreement - in court, in accordance with the jurisdiction.

13.3. The invalidity of certain provisions shall not affect the validity of other parts of this agreement.

13.4. These terms and conditions are available for review on the Website, and, if necessary, may be provided to the Buyer in writing.
